The Impasse Between Universal Music Group and TikTok in Licensing Negotiations

Do you remember when songs disappeared from Instagram? Meta and SIAE had to reach an agreement to allow users and creators to regain access to the complete music library on Instagram. It was a moment of panic not only for those who used to work with the social platform but also for those who, just for fun, used to accompany their Instagram stories with the latest trendy tunes. The same situation could arise on TikTok, and it’s natural that the news could generate even more buzz: before June 27, 2018, TikTok was called musical.ly and aimed to incorporate music and videos into a single platform. Even today, TikTok makes music one of its most interesting features, thanks to millions of users making dances, lip-syncs, and much more go viral.

In a formal communication via an open letter on its official website, the distinguished record label Universal Music Group has articulated the possibility of withdrawing its entire song catalog from TikTok, a platform for which it naturally holds the rights. This potential move stems from the inability of the two entities to negotiate a new licensing agreement, with the current one set to expire on January 31. Three years prior, Universal and TikTok had forged an agreement permitting the inclusion of Universal’s songs in videos shared on the social platform, entailing a commitment from TikTok to remunerate the record label. Failure to renew this agreement would result in the cessation of song usage in videos and the removal of these songs from TikTok’s music catalog accessible to its users.

As per Universal’s official statement, TikTok fell short of meeting the requirements set forth by the Dutch-American label. Universal sought elevated royalties for artists and increased safeguards in light of the growing influence of artificial intelligence in the music industry. Responding promptly to Universal’s allegations, TikTok countered that Universal Music Group would be the sole record label opting not to renew the contract. Anticipating a resolution, it is likely that Universal will yield to contract renewal to prevent discontent among its extensive roster of artists, including Kendrick Lamar, Post Malone, SZA, The Weeknd, and Alicia Keys. Amidst negotiations with Universal, TikTok is actively experimenting with a novel feature, enabling verified creators to incorporate links for purchasing showcased products in their videos through the integration of new technology. Despite being in an “early test” phase, TikTok finds itself in a dynamic period marked by substantial changes.
